Do I Have the Right to Privacy in My Apartment?

When you move into an apartment, you and the landlord will sign a lease that states what each of you is to expect during the time that you live there. It outlines the amount you will spend on the rent, the length of the lease, and who is responsible for fixing what during that time. While the building does belong to the landlord, you are paying them for the use of that building and turning the space into your home for the duration of your time there. As such, you do have some rights while you live there. One of these rights is the right to privacy.

 

Your landlord is not allowed to just come into the apartment any time that they would like, even though they are the ones who own the property. If there is an emergency, such as flooding, and they are worried that it will get to the neighbors and cause more damage, they can just come in and look around, turning off the water and trying to save the apartment, especially if you are not there. But outside of a big emergency, landlords are limited on when they can come into the apartment and each state has rules for when they can do this.

 

Your landlord does need to give you some notice about when they will come into the apartment. Most states require the landlord to give a minimum of 24 to 48 hours of notice before they do this. If it is a routine inspection, they may give even more notice to allow you to prepare before they come on in. Of course, if you invite them in to look at something, then they don’t have to provide you with that notice at all either.

 

If you have a problem with your landlord coming into your apartment without the notice, then you are able to report them. They are breaking the terms of the lease and not giving you the privacy that you are entitled to when you move in.
