Filing for Divorce
The divorce process begins with one spouse filing for divorce and serving the other. A six-month waiting period ensues after the filing before the marriage can be legally dissolved. The petitioning spouse has to serve a copy of the petition to the respondent, who has 30 days to file a response. If the other spouse doesn't respond, the court will assume both parties are in agreement and a default divorce will be awarded.
