Men are especially averse to signing these types of contracts because they feel that they can be exploited by crafty women who would like to marry them only to divorce them and create a steady stream of income or acquire huge finances and assets simply by mentioning their rights as a wife.


There could be loopholes


Unless proper prenuptial agreement templates are used to craft these types of contracts, there could be serious loopholes that might prove to be damaging when it comes to asking for equal rights and share of assets distribution.


For example, any of the spouses, whether the man or the wife, could include some terms or even avoid the mention of some important assets and the non disclosure cannot be detected. Due to this reason, there can be unfairness in the agreement right from the beginning.


Could encourage divorces and make people marriage-averse


Many people and even some legal professionals themselves feel that signing these types of agreements could encourage divorces. Living under the constant pressure of having to fulfill responsibilities enforced by a legally binding document can encourage divorces. Even the thought of having to give another person the right to have a claim on property only by virtue of marriage, which could be extremely short lived, can discourage many people from marrying at all - especially those with poorer finances.
